I will quote again "Crystallex intends to deliver certain affidavids which it claims contains highly confidential information pertaining to its business which, if made known to the public, will cause irreparable harm to it."

Much speculation has ensued as to its being information which in itself is harmful to the company and therefore, of most interest to us, would cause "Irreparable" harm to the selling price. I do not subscribe to this theory for the following reasons which are purely my personal speculations and belief since I have no source of real information and can only reason from observed actions.

I would like to suggest that the only reason the noteholders backed off, from going for the company's jugular, was that the the confidential information itself was beneficial.

I can see the most plausible situation being that the judge caused the company to understand that unless this information was forthcoming to the court the court would probably rule in favour of the noteholders. In such a case the company was probably caught between the proverbial rapidly approaching big rock and a very hard place which could not be escaped from.

Carrying on with my speculation: release of the information would probably cause extreme political distress to the Venezuelan government prior to some official government announcement of something which Fung and the company (and by logical extension the judge and the noteholders) felt was likely to be coming shortly (Prior to July 31).

The extreme political distress to the government itself from any leak of this information was, in my opinion, the thing which would be likely to result in "Irreparable" damage to the company's desire to mine gold at Las Cristinas and thus the noteholders agreed to wait until July 31.

Again I suggest that my speculation here is more likely to be the situation than any speculation of a situation which in itself is harmful, and I can see that as being the reason the noteholders and the judge agreed to maintain confidentiality
