Sorry Don, but you are completely wrong from a legal standpoint.

If we go to arbitration (i.e. if we can figure out to finance it -- the real risk) there is no real issue -- we file against Venezuela. The whole CVG -- Venezuelan government thing is a red herring. Venezuela always challenges jurisdiction on that basis and ALWAYS loses the argument because it is specious. CVG is a creation of the government and ANY actions by the government and/or its agents are atributable to the government.

The BIT supercedes the MOC on seeking remedies and we DO NOT have to litigate anything in Venezuelan courts. Any contrary clauses in any contracts are not valid.

So the bottom line is that we can go to arbitration and win lots of money IF and only if we can figure out how to finance it. Nothing else stands in our way.
