It seems people are assuming that by winning the arb, we get the mine back. I don't think so. The arb is for damages. "You took the mine away from me - I will sue to get an equivalent number of dollars back in my pocket". The mine is gone - it can get awarded to anyone else. I don't think the Chinese care one way or the other about KRY and LC. Vennie is into them for 20+ billion, and the current intention is to get it back mainly in oil.
