Another point is where did the large hedge fund think lawsuits would be coming from? Retail shareholders I would assume in a class action. But on that note who has the money to put up that legal action? The note holders would have been paid off so no lawsuits would have come from them. I don't think Fung is going to get the legal outcome he is attempting in court. He doesn't own any meaningful shares to present a case that he believes in the company. It presents itself as a shell corporation for the benefit of employees and friends. That is the history the court will be reviewing in their decision.
