The 3.8 billion was used in the initial announcement but that was before Compass Lexecon had fully completed their valuation. Sorry, the 3.4 is no typo, that's the number CL came up with. This next thought is pure speculation on my part, so it could be completely wrong, but maybe KRY management was including an interest calculation when they first used the 3.8 billion number. But RM made it very clear to me that the 3.4 number does not include any interest. KRY has asked for interest on the claim, but they feel the panel is sophisticated enough that they will be able to arrive at the appropriate number on their own.
