You may be correct but according to Fung's affidavit dated Dec. 22 paragraph 81 says:
81. In recent discussions, Venezuelan authorities told Crystallex that they were unsure of whom they should be dealing with. I am concerned that this confusion may rise out of messages that have been sent to Venezuela authorities to the effect that stakeholders other than Crystallex management or directors would soon be in a position to have discussions with Venezuela. Whatever the source of that uncertainty on the pary of Venezuela authorities. a CCAA filing and stay of proceedings would make it clear to Venezuelan authorities that the Crystallex board and management continue to be the appropriate parties whith whom to deal on the arbitration or its settlement.
Sure sounds to me like VZ authorities were well aware of the court case and may have been awaiting the outcome before starting any settlement discussions. With the appeal now over with VZ can have no doubt who is in charge and that we have the funds to see this through to the end.
