I'm not saying it's impossible to find them guilty of breach of FD... however, I just think this is not likely. And even if you find something, the penalty would be nothing more than a slap on the wrist. What remedies/penalties do you think is possible here?
My warrant example was only a supplement argument. You did not address my argument about Finskiy transferring his warrants before the board could ask him to exercise
And do you REALLY think warrants will always be exercised?!?! If I were the board, I can argue that 0.39 exercise price, while in the money, would not necessarily be exercised if stock price dips below.
Question my motives all you want. I just want you guys to focus on what's more important... which is... the negotiations, maximization of shareholder value, and not nitpicking over something that would likely not add too much value. I really love to know how you think we could get more money by proving stock price manipulation, breach of FD, or fraud.
