I certainly hope you are correct. I believe the OSC would remain comatose where possible, but the courts will always deal with the substance of a regulatory shortfall and especially where there are fiduciary issues or perceived conflicts of interest. Without a valuation, the shareholders of both SPQ and KWG are left blind. The threatened squeeze by CLF seems shortsighted in the circumstances, and could backfire in a litigation situation. Something must be bugging CLF, since for a small amount of added capital cost, they are risking going down the road with a passive but monied and potentially obtrusive JV partner. Many eyes are upon this so I expect more posturing by the parties. But lets keep in mind at all times, the scheme of securities legislation overall, but the apparent lack of third party buyers. The latter is simply a management issue, and they either have another card to play or they do not. A miscalculation by CLF could prove costly.
