As usual, your post is full of excellent ideas and discussion items.
I spoke with the fine mgmt team at KWG a few weeks back and can confirm that they did indicate that an objection to Cliffs application for easement had been filed with the mining commissioner. It was apparently well backed-up with plenty of supporting documentation.
Some food for thought...who cares what the decision is regarding the easement. Two of the three scenarios are in our favour...a ruling denying the application for easement and a decision tied up in the offices of the commissioner or courts or wherever this ends up. Cliffs cannot more forward in these two scenarios.
Cliffs has set a target of 2015 to start mining - and we all know that much needs to be done to get the ROF house in order (environmental assessments, transportation, power, smelter, FN, etc.). With the global and US economies recovering (slowly but surely) and chromite supplies at risk, I think Cliffs may feel a bit of pressure if this easement issue gets delayed in procedural wranglings. Anyone know of an agile, pugnacious and sometimes rascally lawyer at KWG?
