I get where you're coming from, but remember that their discovery data isn't due for over a month. They may just be still digging for a defense (beyond a "baffle and confuse" approach) in the form of prior art. Even if they find none, they might think they can indeed baffle and confuse a bunch of Texas yahoos - select jury based on low IQs, slack-jawed droilers, fly-catchers, pants on backwards and the like. High risk proposition IMO! Especially considering it's Texas, and the defendents are all "forners" stealing IP from "Marcons" TPL and a company named "PATRIOT Scientific". That alone would scare the doodoo out of me if I were in their shoes, even if I had a defense on merit.
But I KNOW nuttin'!
