My non-solicitors input - it is my understanding that there is no "ruling" by the court on discovery. Discovery is simply the exchange of info by both sides and the courts only inclusion in the process is more as a referee, making sure both sides are playing nice. No "conclusion" is drawn by the court based on discovery info.
