Is the whole inventorship issue even viable???

 My contention is nanotronics owns the invention it signed those rights to PTSC... we own those rights... this argument could only be used if Fish and also wanted develope products using the patents.... see below I cut out a portion the link is below....

 

"If there is no written agreement, then under the common law, the employer may own the invention if one is “hired to invent”. However, to be absolutely sure the company obtains patent rights, it is necessary to prepare a separate contractual agreement.

In some instances, an employee may create new technology using company resources and office tools but not at the direction of the company. Under such circumstances, the company may also be entitled to a “shop right”. A shop right grants the company a right to use or license the new technology for its own purposes. However, the employee may still retain rights in the technology."
