I think Schwartz is making that comment as their opinion as a shareholder. Because perhaps for them as an investor they will probably exit a majority of their position if the ruling is not in favor of PTSC/TPL.
The CEO of a company is not going to say such as"Texas or Bust" ..they are not going to be that frank.... if they lose the ruling...im sure they can appeal...or they will purse other avenues with the cash/patents that they have. The CEO will always try to find a positive outcome regardless of the circumstances/obstacles ahead. Thats their job and thats what companies do.. adapt. The successfull ones continue, the others go belly up.
The Board of PTSC will continue to give the impression that they are confident in a favorable ruling...but at the same time should it not work out their way...will try and spin how there is still value in the company...etc.
