I don't believe that anyone in EDoT is waiting for a decision to come down from the PTO, at least as it relates to a EDoT decision....
First, Judge Ward has a rather consistent reputation of not allowing Stays for the purpose of waiting for the PTO to rule. Second, I seriously doubt that our attorneys would have jointly ageed to the stay if it was for such purpose.
I would not, however, put it past the J's to feign a settlement for the purpose of stalling when in their heart really had no intention of settling. Yes, they would encounter the rath of Judge Ward, but if the PTO went their way, they wouldn't care.
I suspect, we will see a motion for summary judgement if the J's tried to pull the later. Or, a settlement if they were sincere in the perceived reason for the stay which was to settle.
