If we request a MSJ and are awarded damages and the PTO rules against us. I don't think we are going to be able to keep the money anyway. So why should the J's settle ahead of time? Only to save cash unless they feel they will loose PTO ruling. If they feel they have a chance to win the PTO ruling they will not settle. So far they have not. I think it will all come down to the PTO ruling. If the J's get the slightest hint they will lose they will settle fast.
