If a company feels that the MMP isn't airtight, they don't pay one cent in the first step. After the positive MH, many learnt to argue with the MMP but still see the chance that TPL/PTSC fails in court or at the USPTO, but the risk is high that they won't do so in total. So they have to make the decison to buy a MMP licens at a moderate rates or to be faced with higher rates after a trial or settlement in TX. It's aquestion how much risk you'll take.
