Higgins was acting for both Fish and Moore on the patents. Fish waived his ACP rights, Moore did not. B&O tried to get the Moore ACP material admitted as evidence. This was not allowed at trial nor at appeal. B&O were sanctioned for attempting to breach Moore's ACP.
