This is an extremely interesting statement - at least, if you assume Dutton and Cohen are part of Patriot's "communication tools" (as I do), to tell the market things without telling it by their own (if anyone understands, what I mean...lol)
Given the NDA I would NOT expect to hear anything about "the magnitude of the settlement" in the 10Q (which, btw, I expect to come out at 01/14) - it wouldn't make any sense to publish the J3 $$$$$$ at the 14th of January, but not on the 18th of December, because nothing significant happened between these four weeks.
IMHO the NDA only makes sense, if the numbers do not show the CONCRETE magnitude of the $$$$$ paid by the J3 = the more licensees in this quarter, the more difficult it gets to separate the dollars.
Of course this only makes sense, if the NDA was made to hide the J3's financial burden...something we don't know.
The next very interesting and encouraging phrase is "huge win":
In clear opposite to those, who didn't recognize/accept the "business resolution" as a settlement and thus not as a win for TPL/PTSC, Cohen states this event as what it is: a HUGE win - nearly independent from the financial outcome!
Because even without looking at the dollar side of this settlement, it means a great release from all the things/energy a litigation means for the involved parties (I know, a lot of you think, the BoD are drinking cocktails, while TPL is working - I see this in a different way...).
Regarding the ridiculous low shareprice I have to think of Dutton's Initial Report stating the high number of Outstanding Shares as the first negative for Patriot. I always saw this "negatives" list as a plan, Patriot was and is working off. Today most of the points are solved (Fish, Giffhorn, J3, warrants), the only ones left are USPTO, no predictable revenues and the OS. I'm still confident, they are working on reducing the OS and as I speculated some days ago, one way could be to let the J3 buy as much shares they can until April 08 for a fixed amount of dollars. So Patriot would NOT be interested to support the shareprice.
I know, this is a rose colored glasses WAG, but it sounds good to me...lol
