Yes.. you are wrong... now please get your facts straight before continuing to post this stuff
They have not received the Non-Final for the '336.. may not get it utill this fall, if it follows a similar timeline as the '148's
The time limit is 3 months I believe, for rebuttal to the Non-Final.. at least that is how long the rebuttal to the '584 took...

'336 patent: 01-30-2007 Receipt of Original Ex Parte Reexam Request 11-28-2007 Date Forwarded to Examiner ------ IMO the '584 Non-Final Axn came more quickly due to the Markman ruling.. If the '336 more closely follows the '148 timeline, it appears we may not see its Non-Final Axn until this fall... tho it seems to have taken quite a while to forward the '336 to the Examiner... occurring approx along with the Js settlement It also appears we should get the Moore/TPL response/rebuttal to the '148 Non-Final Axn sometime around mid March |
