I absolutely hope Virt's take is correct.. but I personally believe what Ease and CenturyCom have posted.. that TPL decided to cut bait and settled for a moderate amount on their license fees, in order to allow the PTO to finish the reexam process, which would eventually have to be seen thru to resolution regardless. They still retain the Markman Ruling, and that coupled with USPTO Reexam validity will give TPL all the cards for future negotiations & litigation.
If true... while I am disappointed we didn'y drill the Js for $100Ms, I can accept the decision if they feel it is the better road to validation...
