The timeframe on the ..148 patent should be very close at hand. If I read it right the reexam was initiated 2 years ago and that's about right for a completion of the reexam..usually 18-24 months.
on the ...336 patent you will note the following dates...
90/008,227 filed on 09-21-2006 which is Pending claims the benefit of 08/484,918 |
90/008,237 filed on 11-17-2006 which is Pending claims the benefit of 08/484,918 |
90/008,306 filed on 10-19-2006 which is Pending claims the benefit of 08/484,918 |
90/008,474 filed on 01-30-2007 which is Pending claims the benefit of 08/484,918 |
I assume the even last date of 1/30/07 is not one we should work from only because I think it was the date of 4/18/08 used when they combined them all into one. This is a confusing one. Since they combined all the requests for reexamination under one examiner it depends how far along that particular person was on any one reexam. If he has to do all of them before he responds with his decision we could be waiting a long while for...336. Remember there are multiple requests for reexams on ..336 as compared to only one on ...148.
Lastly, one could assume that the litigation search is a prelude to the finalization of any one patent...that is possible. But, remember, this search could also be for the latest cases filed in No Calif. too. They need to be reviewed because they are relatively new events in the proceedings of this reexam. Litigation seaches could be a one-last-step type item but also just a mid-stream event because of new litgation preceedings.
Don't want to rain on anyones parade here....just be cautious and expect a longer period for the ..336 as compared to the ...148 patent.
