There is at least 2 obvious clues that the 148 cert is coming. First the litigation search. Part of tiding up the file before closing it out. Next, and seemingly quite obvious, is the 5/27 IDS. Look at the bottom of that first page. It is dated 5/22/08. Why would we be resubmitting stuff if a final rejection is on the way? I believe this is part of getting the reexam file in the proper order for recertification. If that is not the case, then the examiner has completely lost it. IMHO. Have a great weekend everyone.
