Message: A letter from Sam Remill (PTO examiner for the 336)

As identified in 37 CFR 1.530, we can file a submission of prior art limited to a listing of the information disclosed and an explanation of its relevance. We filed one of these forms on 09/20/2007, "Information Disclosure Statement", where we cite our identified listings of prior art. Simply review the '336 and you will see this filing on 09/20/2007, and on page one, we list all of the patents that we are submitting as prior art. I don't see any specific reference to Kajigiaya in this disclosure.

The patents we disclose in this filing as prior art (not including our own) are:

5133064

4872003

4816996

4783734

4750111

4718011

4710648

4660155

4503500

4494021

4453229

4334268

4223380

4079338

4037090

3919695

I have looked at every one of these patents, and none of them are tied to 52 US Pat 54148652, apparatus for controlling a power source, Assignee: Cannon Kabushiki Kaisha, which is the patent you are referencing in your post:

http://www.agoracom.com/ir/patriot/m...

"The first C you come to will give the name of an inventor and the number."

Based on this information, it is my opinion that it is the examiner who has made the reference, not us, as I can't find any documentation that specifically states we brought Kajigiaya to light. Again, as stated in my last post, I believe the examiner brought this to light as a result of the recent KSR rulling, and IMO in the end it really doesn't matter, as long as we defend it and come out with a strong patent. I hope this to be the case, because I believe we are all here for the same reason...to see the value of our investment go up, and I believe we ALL deserve this.

I hope things are well. Good luck to you, me, us, and all longs.
