I believe you are half right with that statement. The USPTO reexam possiblity was identified long ago by "Danny boy", from the third party watch dog. I don't remember the name of his organization. The grand illusion, that threw everyone off base, was the J3 settlement. We got screwed and nobody is saying why. It has been all downhill since then.
