I wish I had the time this weekend to do some more DD to re-familiarize myself with some key issues, but unfortunately I don't. If I recall in regards to the 336. I remember Judge Ward asking Roger Cooke about the two independent clocks, and using the example of he and his wife walking down the street together...her having shorter legs (?) but yet able to keep up an example of varying together. If I recall the USPTO examiner had trouble with the term of two independent clocks.. how could they be truly independent if they varied together? I guess this is still up in the air? . I would imagine by the claim construction that Judge Ward agreed with that aspect of the claim. I hope it carries a lot of wait with the examiner.
Does anyone have any additional information on this?
