Very simply, the reason for that...at least over the last year or so, is that the licensing cost is so small it is better to pay, with a disclaimer of non-infringement, than it is to pay for the legal cost.

The last two averaged $1.4MM each...thats small change when weighing that against paying for legal representation over a year or more. They consider it a nuisance fee , pay it ,and move on, esp. so if there is no ongoing royalties to pay for future production/usage.

It will continue ot be that way till the patents have a reexam certificate issued that doesn't lessen their strength of enforcement.
