It might help to read this from the german patent court's website:
"The Federal Patent Court - as well as the German Patent and Trademark Office and the
Federal Office for Plant Varieties - is competent only for cases regarding the granting or
the refusal of an industrial property right (patent, trademark, utility model, semiconductor
topography, industrial design, plant variety right). In addition to this the Court may nullify
a patent or other industrial property rights. Decisions on the infringement of industrial
property rights are exclusively dealt with by the civil courts of general jurisdiction (in so-
called infringement suits)"
