The '584 had a Final Rejection on Dec. 5/09 and it is being appealed. It now seems that the examiner has been slow to enter an agreed upon amendment and a Notice of Appeal and Transmittal of New Application was filed on Mar. 9, 2009 which states that it's purpose was to provide more time for the examiner to do so....which seems odd to me BWDIK.

Comments welcomed as to why the onus is on us to provide more time for the examiner.
