As I stated in my previous post it depends on how you want to view it. You can't have a reexam if a patent isn't valid, so I guess we now know the mystery answer to that question. The flip side is obvious, the patent life is being sucked out from under us. TPL can't possibly afford to file hundreds of lawsuits before the patent life expires. IMO another question has now been answered. We know why Mr. Goerner is pushing so hard to rid us of being know as a technology licensing firm. The pie chart they have up, is there for a reason. There are to many unknowns with the MMP revenue. I assume the German validation may have revived the '336. Perhaps the initial '336 rejection was stronger than we realized. Licensing activity may continue it may just be a smaller list of infringers that can be tied to Germany, pending a USPTO resolution.
