Milestone, Thank you for your point of view re your statement that "The NDA is between TPL, a private company, and the licensee and/or litigant". However I am more inclined to favor Biajj in this regard. Please refer to his post below.

Your statement made in a vacuume is correct, but this is not a vacuume; there are other issues, regulation and authorities to be considered.
