Well actually you may be right on target. The last response on the 336 should have put it in condition for recert. But the examiner initiated an interview in which he, the examiner, proposed an examiner's amendment. That exchange took place subsequent to denying a filing date on the reexam request which contained improper/premature arguments. All IMHO.
If the 336 was in condition for recert, why the need for an examiner's amendment????? But I agree it's hard to envision the USPTO as being helpful. Hell might freeze over first.
