Those not interested cannot file an appeal, only we can appeal a USPTO decision. They are not allow to communicate other than through their ex-parte request

What I find troubling is that the USPTO was awaiting re-submiittal of a exparte reeam request for a request that was previously rejected. They gave a 30 day extention for re-submittal, they received it on 8/24 which I thought was a day late. Since they are not allowed to communicate with the USPTO other than in their exparte-request someone else must be involved. Perhaps the court wants to get all this perfectly clear once and for all and is communicating with the USPTO. Still if their reeam request was late it technically it should have been denied.
