Thanks for pointing that out. Please correct me if I'm wrong, but are you speculating that it is fully within his rights yet unlikely the examiner is agreeing with the SNQ's but has ordered the reex based on a technicality and is waiting for the issuance of the reex certificate before proceeding with an Office Action?

Please note that I appreciate your thoughts on the matter and don't mean to put you on the spot or be argumentative, I just want to make sure I am correctly understanding the important point you are making.
