Most on this forum have been working under the assumption that PTO revalidation was required before proceeding far in a legal venue. Now revalidation of the 336, listed as the primary IP of the MMP, has been revalidated. TPL has no excuse to not take this to the end game.

The question is: Does TPL blink again like they did against the J3? Personally, I think it was necessary to blink then. If they blink again with 336 recertification, then that should be a very telling sign.

I like what you posted above. Along those lines this Q shold reflect higher license fees and could be telling.

The other question is, if TPL isn't now going after infringers more aggressively is it because they 1) lack the funding 2) are still concerned with the latest USPTO re-exaamination of the 336 3)want to finish the existing litigation in California first before going after others 4) don't have confidence in their legal team 5) satisfied with small license fees trying not to upset infringers 6) want to put the ownership issue with Moore to bed first 7) somthing else.
