At the time of the agreement, hadn't TPL/Moore already signed Intel?

Before AMD is used as a counter, check how much PTSC received from TPL/Moore on signing the agreement as the portion of Intel's fee.

Look at what else was also resolved with the agreement. To simply say TPL was given too much power without considering all the prevailing facts is simply denial of the circumstances.
