It's all about context:

I have been on this board for many years now, and while that certainly doesn't entitle me to anything, I must say that I am absolutely amazed at the immediate intolerance that is spreading here. We finally get a patent lawyer among us (and he does, indeed, appear to be one), and merely because he says a few things about the law that some people don't agree with (largely because they themselves don't know what they are talking about), he is immediately labeled a basher. I couldn't care less even if he does represent the J3 or some other potential defendant, if he can explain patent law to us, that's great --- as you have already shown, it is easy enough to verify or refute what he says, and at least he gives us a specific direction or concept to pursue or discuss. There is something to the adage of keeping one's friends close and one's enemies closer --- I don't know wherther Apl is actually an "enemy" or not at this point, but he has certainly pointed us to to some good legal authority for discussion.
