AS per the recent (07/29/10) non final OA

Claims 4,6-8,10,11 and 13 are subject to reex.

Claims 1-3,5,9 and 12 are not subject to reex.

Claims 8 and 10 have been cancelled.

Claims 6,11 and 13 are patentable and/or confirmed.

Claims 4 and 7 are rejected.

It also states that the shortened statutory period for response is set to expire in 2 months from the mailing date.

Thinking of fighting USPTO in appeals court is a little premature knowing Henneman's past performance IMHO.
