Considering they have licensed only 23 of the top 100 electronics companies (as of 2006 rankings), amongst the 81 or so licenses signed, (at least from disclosed licensee names), it would seem there may be quite a bit of value still in the MMP today. The first 81 licenses brought in over $305M.
Considering the patents are now largely done with the USPTO re-exam process, it would seem their inherent value would now be greater as they are less assailable than they were previously. The question, IMO, would be have they been weakened by the process, and though I'm no EE, it would appear based on my understanding, that if they have been weakened, it's not significantly so.
Of the first 81 licenses, 23 are from the top 100 and those are spread fairly evenly, meaning we haven't taken all the top 20, or most of the top 50, etc. If we were to license then next 23, they have the opportunity to be a simliarly sized range of companies, and thus logically, might bring in a similarly scaled license fee total. If they intersperse those 23 with another 50 from other market segements (ie. auto, instrument, etc. etc.), it stands to reason, there could well be another $300M in MMP revenues to be gotten, if not more.
The question in my mind is not so much the value of the patents, but are the partners able to orchestrate a licensing program that will properly monetize them. As we have seen over the last year, the challenges are more from within than without. TPL, Moore and PTSC have essentially been their own worst enemy if you consder them a TEAM. They've rather worked as individuals seeking to maximize their own interests. In TPL's case, trying to take advantage of the licensing freedom Moore and PTSC so foolishly granted them. In Moore's case, apparently too naive and business ignorant to understand what he had signed up for, and too focused on his next creative steps. In PTSC's case, too interested in serving specialized interests of the BOD members and likewise too business UNsavvy, to properly steward a public company for the benefit of SHAREHOLDERS, and to proud and arrogant to realize they needed to correct the problems, and based on continuing interaction with shareholders, perhaps STILL that way.
That being said, if TPL, Moore & PTSC can remove their heads from their nether regions, and realize that their individual piece of pie could be much LARGER by accessing the LARGER PIE, instead of trying to hoard more pieces of a smaller pie, then perhaps the past results can be duplicated and even enhanced. Hard to say due to the woefully disappointing players involved, and the difficulty in understanding all of the technicalities of the patents and infringment claims.
Step One in my opinion is to stop cannibalizing one another (TPL, Moore & PTSC), and figure out a solution QUICKLY that turns infringer laughter at the MMP Ownership, into infringer respect and fear of them and the likely consequences. To date, I'm afraid that the TPL/Moore/PTSC saga has afforded infringers the LUXURY of delaying licensing and delaying licensing and delaying licensing...etc. etc. etc.
Let's hope they have some positive and STRONG news that might change that dynamic soon.
Here's the top 100 list, with those licensed already in Green. Keep in mind, with the new non-disclosure of even the licensee name, this may not be fully accurate, but for how much I'm getting paid to post this, you'll have to make do, lol.
