The Markman in Tex was a near across the board victory... The J3 was settled IMO to assure the USPTO results were what we wanted as opposed to a jury deciding with potential influence by the J3... In the USPTO (as known) only PTSC/TPL were there giving guidence. Now we have what appear to be strong validated Reexammed patents going into a Markman which has basically or to some degree already been argued... I would hope the Tex Markman supplies a very nice template for our legal counsel to follow, and adjust accordingly..
