I, Brandon Baum, declare:
1. I am licensed to practice law in California and appear before this Court, and I represent Technology Properties Ltd. and Alliacense Ltd. (“Defendants”). I have personal knowledge of the matters set forth below and if called to testify, I could and would competently testify to the facts set forth herein.
2. Defendants’ reply papers for their claim construction briefing were originally due on Friday, January 13, 2012. However, we became aware last week that the Court’s ECF web site would be down for technical maintenance starting at 5:00 p.m. on January 13 until 6:30 a.m. on Tuesday, January 17, 2012.
3. Cognizant of Section VI.E of General Order No. 45, on Friday, January 13, 2012, counsel for HTC Corporation, Kyle Chen and I jointly inquired of the Court regarding the deadline for the filing of Defendants’ reply papers (which would normally have been due by no later than 11:59 p.m. on Friday, January 13, 2012). We were informed by the Court’s Clerk that that she understood that Defendants would have until Tuesday, January 17, 2012 to file their reply papers, but that she wanted to check with a person in IT to be certain. Later that day I received a call from the Court’s Clerk confirming that filing of the reply papers needed to be completed by 9:00 a.m. on January 17.
I declare under penalty of perjury under the laws of the United States that the foregoing is true and correct. Executed on January 17, 2012, at Menlo Park, California.
