In answer to my own question, it does not appear that any of the four patents in that other IP suit have been reexamined.

5307459, 5299313, 5434872, 5732094

So no surprise that the court is finding some ambiguity in some of the claim language. Hopefully such ambiguity will not be found in any of the MMP patents after the USPTO has picked apart every word and phrase.
