I don't know how you would draw a comparison between then and now. The Markman was followed by the body slam of the exparte reexaminations and a year later by the J3 complaint. Although you can blame management for alot of things I don't believe you can blame them for the fact that the Patents were exposed and needed to go through the long process in the PTO to become valid again. I say again because I know they were supposedly valid from the get go. But perception is everything.
As for share price and revenues who in their right mind would pay big license money knowing that the patents have a chance to be invalidated. Unless they were offered sweetheart deals I would have chose to wait and see as well.
I think many companies are waiting for the outcome of this Markman and it will be the defining moment in our companies history. If we prevail on the Markman and the wave never shows up then I say get the tar and feathers ready. We are closer then ever to having a patent with no excuses as to why we are not licensing. I am betting on the fuse being lit and it being a short one at that.
