This brouhaha/fixation with terminology,is being raised by the Lawyers, to confuse the real
crux of the claim ie: the MMP attains maximum speed under varying conditions and they
--the Lawyers--know that. So they are raising a RED HERRING to muddy the waters..
The Talbot configuration sets an upper limit on the processer speed--The 336 does NOT....
Simply stated..For purposes of CYA/CMA.... IMO
