The "negative implications" you are talking about sounds like an Offer of Judgment. If an accused party makes such an offer, there are some (relatively toothless) consequences if the offeree later gets a judgment for less. But the Offer of Judgment has to be made in the first place--this is not automatic. There have not been any Offers of Judgment here that I am aware of.

As for imposing the "full force," that may well happen if HTC and Acer go all the way. It seems like, after litigating this hard and long (and spending this much money on legal fees) that they are going to go all the way. I believe G has set a trial for summer 2013, so these are interesting times we are living in, no?
