If the judge denies the last motion for more clarification the writing will be on the wall in permanent ink. The ITC case will be a gauge on what leverage they have on settlement talks. IMO even if I knew I infringed and was planning on settling I would use the variable of a jury outcome as a mitigating factor on the dollar amount.
