Surprised only 14 thumbs on this. Although preliminary, would you like to be the respondents and read that the research the court has analyzed so far, agrees with the interpretation of previous Markman's regard 336. I would think this would generate a little discussion here. I suppose I am reading too much into it....seeing that it is only an initial finding, by the staff, not the judge. However, the motions ruled on so far, together with this opinion and other delays in responses by the ITC 12, feels like the offensive momentum is gaining support.
