Actually I think the problem over the past five years or so is that companies were not keen to license because of the continuous challenges to the validity of the patents themselves. Why would any company voluntarily license with the possibility of the patent being being thrown out altogether by the PTO?

They played chicken and they lost. Now pay up, big time.
