I should've been more clear in my post. End result is the Respondents will not be allowed to file a motion for summary determination on infringement as the ALJ denied leave to do so. That is my interpretation and is good in that the Respondents will have to wait until the trial in June to make their case. As long as the Markman falls our way this will all be good for us going into the trial.
