Sounds plausible to me. Unfortunately, short of knowing the actual construction by Judge Gildea and his reasoning behind the construction, we just don't know. It is possible that the staff's construction was adopted, or some separate construction was determined. Also, it's possible the "correction" was to correct the reference to a case that was cited by one of parties to make their point. My idea is equally as plausible. Should be interesting whatever happens ...
