As I recall, Nintendo was not included on the MSD (which has not been ruled upon). Therefore, even if the MSD were granted, wouldn't the case still go to trial for Nintendo? I did not see a statement regarding a settlement conference for Nintendo (indicating that settlement talks were held and resulted in an impasse) which seems rather interesting. Just a thought...
